Terms and Conditions
1) Scope and Provider
These Terms and Conditions (“Terms”) govern the use of www.comforties.com (the “Website”) and all sales of products made by Comforties.com Ltd. (“Comforties”, “we”, “us”, “our”) to consumers (B2C) and business customers (B2B) within the European Union. By placing an order, you confirm that you have read, understood, and agreed to these Terms.

2) Privacy and Cookies
We process personal data in accordance with the GDPR and applicable national laws. For details on categories, purposes, legal bases, recipients (e.g. shipping and payment providers), international transfers (if any), retention, and your rights, see our Privacy Policy.
The Website uses essential and, subject to your consent, non-essential cookies (analytics/marketing). You can manage consent any time via the cookie banner.
3) Pre-Contract Information & Contract Formation
Prior to checkout, we clearly provide: main product characteristics, total price including taxes and delivery costs, payment and delivery methods.
Product listings are invitations to treat. A binding contract is concluded when we send an order confirmation by email. We may refuse or cancel orders in case of pricing/stock errors, compliance risks, or suspected misuse/fraud. We will provide the contract summary and these Terms on a durable medium (e.g., email or PDF link) after the order.
4) Prices, VAT and Invoicing
Unless stated otherwise, consumer prices include VAT (TTC). B2B prices are shown ex-VAT; VAT is applied according to EU rules.
For intra-EU B2B orders with a valid VAT number, the reverse-charge mechanism may apply. Invalid or unverifiable VAT numbers will incur standard VAT.
Invoices are issued electronically. You consent to electronic invoicing.
5) Payment Terms
Accepted methods are displayed at checkout (e.g. bank transfer, card, PayPal). Prepayment may be required for risk-based reasons.
B2B on account: invoices are payable within 14 days of invoice date unless otherwise agreed in writing.
In case of late payment (B2B), default interest of 1.5% per month may apply, plus reasonable administrative/collection costs. Deliveries may be suspended until full payment.
No surcharges are applied to common consumer payment methods where prohibited by law (PSD2).
6) Shipping, Delivery and Risk Transfer
Shipping fees: Free delivery for orders ≥ €150 net; for orders < €150 net, a €6.95 delivery charge applies (unless otherwise stated at checkout).
Delivery times: Indicative 2–3 business days after order confirmation (up to 5 days in exceptional cases). We will notify you of delays and offer options (wait, substitute, or cancel/refund).
7) Customer Accounts & Accuracy of Information
You must keep account credentials confidential and ensure that all order, billing, and delivery details are accurate and up to date. You confirm you have authority to place B2B orders (where applicable).
8) Right of Withdrawal (Consumers Only)
Consumers have a 14-day right to withdraw from the contract without giving reasons, starting from the day of physical receipt of the goods.
To exercise this right, contact [email protected]. You may use the EU model withdrawal form (optional).
Return goods within 14 days of withdrawal notice. You bear return shipping costs unless we failed to inform you otherwise at checkout.
We refund all payments received, including the standard outbound delivery cost, within 14 days after receiving the goods back or proof of return (whichever is earlier). Refunds are made to the original payment method unless you explicitly opt for store credit.
Hygiene exception: Sealed hygiene or medical products (e.g., gloves, bibs, masks) are excluded from withdrawal once unsealed for health protection reasons (per EU consumer law).
9) Returns, Inspection and Complaints
Please inspect deliveries upon receipt. Transport damage or shortages should be reported without undue delay (preferably within 48 hours) so we can claim with the carrier.
Return instructions will be provided for approved returns. Items must be returned in original or equivalent protective packaging.
B2B returns require prior written approval; a handling or restocking fee may apply unless due to our error.
10) Warranty and Conformity
Consumers: You benefit from the statutory legal guarantee of conformity as implemented in your country (minimum 2 years within the EU). Remedies include repair, replacement, or refund according to law.
B2B: Unless otherwise agreed, the warranty period is 12 months from delivery and covers defects in materials or workmanship. Remedies (at our discretion): repair, replacement, or credit of the net price.
Exclusions: misuse, abnormal storage, use beyond expiry date, non-compliant handling, unauthorized modifications, or normal wear and tear.
11) Liability
Nothing in these Terms limits liability for death, personal injury, or fraud, or any liability that cannot be limited under applicable law.
We remain fully liable to consumers as required by mandatory consumer and product-liability laws.
B2B: To the maximum extent permitted, we exclude liability for indirect and consequential losses (including loss of profit or data). Our total liability is capped at the invoice amount of the goods concerned.
12) Retention of Title (B2B)
Goods remain our property until full payment of all outstanding amounts. You may not pledge or transfer ownership as security before title passes.
If you resell goods subject to retention of title in the ordinary course of business, you hereby assign to us your receivables from such resale to the extent of our outstanding claims.
13) Language, Jurisdiction and Applicable Law
We offer contract languages as shown on the Website (including English, Dutch, German, French, and Spanish). Consumers receive pre-contract information and confirmations in a language they understand.
These Terms are governed by the laws of Bulgaria (our country of establishment). Consumers also benefit from the mandatory consumer protection provisions of their country of residence.
B2B: Exclusive jurisdiction is the competent court in Varna, Bulgaria, subject to EU jurisdiction rules.
14) Out-of-Court Dispute Information (EU)
Following the closure of the former EU ODR platform (July 2025), consumers can consult the European Commission’s list of national consumer dispute resolution bodies at: https://consumer-redress.ec.europa.eu/index_en.
15) Changes to These Terms
We may update these Terms to reflect legal, technical, or operational changes. The version displayed at checkout and sent in your order confirmation applies to that purchase.
